38 Studios Lands Former Employees with Second Mortgages?

Yesterday, hundreds of staff from the beleaguered studio behind Kingdoms of Amalur: Reckoning were laid off. Today, if the latest reports are to be believed, things have got much, much worse.

Apparently, some of the employees from ex-baseball star Curt Schilling’s 38 Studios have been informed by banks that the homes they thought had been sold to the company have remained in their name. 

That means that not only have they lost their job, they’re also unknowingly defaulting on a mortgage the were assured they no longer had. Unpaid mortgages can lead to personal bankruptcy and homelessness. 

It’s being speculated that those involved with 38 Studios’ relocation program are the victims. While moving from Massachusetts to Rhode Island, 38 Studios offered to buy their employee’s old homes to make the process of relocation a little quicker and easier. Except it would seem that didn’t happen.

Or, at least, it didn’t happen in the way that employees had been led to believe. Instead it’s being suggested that 38 Studios did not buy the homes from those employees at all.

While much of the story is yet to be fleshed out, Polygon are claiming that “several sources” have confirmed that they’ve received massages from their banks asking why their old mortgages have not been payed.

Further questions have also been raised regarding the legality of 38 Studios’ use of state money. The company has received significant investment from Rhode Island itself, money that you are not legally allowed to spend on financing homes or paying mortgages.

38 Studios are also facing accusations from Gov. Lincoln Chafee that because they didn’t alert the state ahead of time about the company’s 379 layoffs, the company is once more in default on the loan agreement with Rhode Island.

Whatever the outcome, expect this story to run for some time. It seems increasingly likely that alongside the continuing case between West/Zampella and Activision, this year’s biggest headlines will be more about courts than consoles.

As much as I want to put the blame on the studio, if someone says they're buying your house, get a lawyer to do the finalizing paperwork.

Agreed with #1, this sucks for everyone involved, so here's hoping everyone comes out good in the end.
I'll admit though, I missed this game, was it any good?

Now I feel bad that I bought the damn DLC, because the senior executives prolly pocketed that money instead of paying their employees. Sad. Now I won't feel sad about trading that game in.

I wonder if the DLC will drop in price now or just get taken down from PSN. More than likely it will probably remain the same price. Personally I don't blame EA since they just publish the game. I blame the people in charge of payroll and management for 38 Studios.

38 Studios just can't catch a break once they hit a downward spiral. Too bad for them, KoA was a surprise RPG that I though should have done well for us gamers this year and if there was future DLC and a part 2 I would have bought it. The management team should have been more productive and keep an eye on things, (epic failure on their part) and now the little guys are talking the hit.

This is so sad because Curt Shilling has millions in the bank, but hes not going to help this people. He sure was everywhere promoting the game. Now I want to see him be a man and go on Conan and explain why he F&^% all this people over, but of course he wont because just how the blody sox was fake he is fake. He should help this people with his own money then again what can you expect from a former Red Sox player.

Oh Curt, I love you for bringing my Sox a long overdue championship but you really mismanaged this whole studio. For those that don't know, he is a staunch republican who constantly criticized dems in the local media for handing out money to companies through tax incentives. That alone is fine but when he decides to start his own business and gladly accepts handouts, the very thing he's be scrutinizing all these years, he becomes an obnoxious hypocrite. Once the state gov decided to supported him, the first thing he did was make sure he reimbursed himself the $4 mil of his own money he had initially spent. He loses NOTHING, his employees lose EVERYTHING. Go to the Boston Globe and Boston Herald websites for some interesting reads if you want to know more about this..... and sorry for the rant lol.

This does not sound nice at all, i'm really sorry for them, here is my best wishes to ex-employees, i wonder if we can help them? would it be good to buy the game and DLC ??

I dont think buying the DLC helps them. It puts the money in EA and probaly the people who caused this. This is why our country is so messed up the goverment helped them get started they meaning the jerk Shilling got his money back and then he screwed the guys who did the work over. Untill they stop people like this we well keep having this horible economy, but they well spend money to see if baseball players wher doing steroids, but this not this at all even though what this guy did was stold from the poor to give to him self. Hes a criminal in my book. So Please no one buy this game or the games DLC lets stop feeding the PIG.

@16: Money from game sells goes to the publisher. The developer usually got paid during development while they hit their milestones and if the game hits certain criteria - like 85+ at metascore and/or 3 millions unit shipped in 6 month they'll get a bonus as mostly stated in the contract. If a game continues to be successful, they can usually count on further boni. I'm not sure about DLC, though. My guess with all the day one, pre-order and disc locked DLC is, that it's handled the same and already part of the initial publishing contract.
However, this is only for free development studios. If they are part of the publisher, they'll get continually paid by him, obviously.
This is also why so many studios have to close. If they can't find a publisher, they can't pay their employees.

This is clearly a case of mismanagement. Or pure douchebaggery from the management if they got money out of this.

@19 Yes but EA didn't have anything else to do with the game in terms of funding all they did was oublish it under the EA Partners scheme.

So the lame for once doesn't lie with EA. Can't believe i'm defending them but more getting the facts down.

@18 Most of the money in the EA PArtners scheme goes to the developer. If 38 studios was owned by EA then ofc the game probably would have had more marketing and better sales. But as EA take in sales was low they do less in marketing.
