selecting hard difficulty problem?

I started a new game (with the good karma playthru from my infamous 1 play) and I changed difficulty once I arrived in the swamp, is that too late?.
I had the impression that the beast fight is only a kind of tutorial and I did not have the option to go into the menu?
Can you actually die during this fight?

Anyway, wtf, they try to sell this as a triple A title and can't even include a 'choose your difficulty' menu.

I did it this way, just to be sure (this is from the Trophy Guide):

To ensure you unlock this trophy when you attempt to complete the game on hard, follow these steps:

1- Start a new game, and as soon as you gain control of Cole, press Start to enter the in-game menu
2 -Go to Options and change the difficulty to Hard
3 - Save, then start another new game

You'll now begin the game automatically on Hard

Like many others I got the "promoted to Hard" message even though I was already on Hard. Trophy unlocked just fine for me.
