Default Sitting on the "L" bench

How come Leonardo Da Vinci appears when I sit on this bench when he's supposed to be missing?

This DLC has some continuity issues, let's leave it at that.

I specifically avoided that bench during the DLC because I knew it would shatter my suspension of disbelief.
